Provider Terms of Service

These Provider Terms of Service (“Provider Terms”) apply to crematoriums, funeral homes, and related service providers (“Providers,” “you,” or “your”) that access or use the CremateConnect.com platform (the “Platform” or “CremateConnect”).

By registering as a Provider or purchasing access to service requests through CremateConnect, you agree to these Provider Terms, as well as CremateConnect's general Terms of Service and Privacy Policy.

1. What CremateConnect Does (and Does Not Do)

CremateConnect connects Providers with individuals or families seeking cremation-related services.

We:

• Facilitate the delivery of consumer service inquiries
• Provide a self-service system to receive and respond to requests

We do not:

• Guarantee business, revenue, or conversions
• Set or control your pricing
• Represent or endorse any Provider
• Participate in service delivery, billing, or disputes

Your relationship with Consumers is entirely independent of CremateConnect.

2. Provider Eligibility and Requirements

To use the Platform, you must:

• Be a legally registered business
• Hold all required licenses, permits, and certifications
• Be authorized to provide services in your selected service area
• Maintain compliance with all applicable federal, state, and local laws

You represent and warrant that all information you provide is accurate and current.

3. Provider Accounts

3.1 Account Setup

Providers must create an account and complete onboarding, which may include:

• Business verification
• License verification
• Payment setup
• Selection of service areas and preferences

You are responsible for maintaining the confidentiality of your login credentials.

3.2 Account Accuracy

You agree to keep all account information accurate and up to date, including:

• Licensing status
• Contact details
• Service availability

Failure to do so may result in suspension or termination.

4. Nature of Service Requests

4.1 What You Are Purchasing

Providers purchase access to consumer service requests (“Requests”), not guaranteed customers.

Requests:

• Are based on information voluntarily submitted by Consumers
• May be shared with a limited number of Providers (typically 2–3)
• Do not guarantee consumer contact or engagement

All sales are final unless otherwise required by law or explicitly stated.

4.2 No Exclusivity

Unless expressly stated, Requests are not exclusive. You acknowledge that:

• Other Providers may receive the same Request
• You do not have visibility into which Providers received a Request
• Consumers are free to choose any provider—or none

5. Fees, Pricing, and Payments

5.1 Fees

Providers may be charged:

• An onboarding or activation fee
• Per-request fees
• Subscription or access fees
• Other disclosed charges

All fees are:

• Clearly disclosed before purchase
• Non-refundable unless otherwise stated
• Subject to change with notice

5.2 Payment Authorization

By providing payment information, you authorize CremateConnect to:

• Charge applicable fees
• Collect taxes where required
• Use third-party payment processors

You are responsible for all charges incurred under your account.

6. Provider Conduct and Consumer Care

6.1 Professional Standards

Providers agree to:

• Communicate respectfully and professionally
• Comply with all applicable consumer protection and telecommunication laws
• Honor Consumer contact preferences where reasonably possible

Aggressive, misleading, or exploitative behavior is strictly prohibited.

6.2 No Misrepresentation

Providers may not:

• Misrepresent CremateConnect's role
• Claim exclusivity unless explicitly granted
• Imply endorsement by CremateConnect

7. No Guarantee of Results

You acknowledge that:

• CremateConnect does not guarantee leads, volume, or conversion
• Consumer decisions are outside our control
• Non-response or decline by Consumers does not entitle you to refunds

8. Privacy and Data Use

8.1 Consumer Data

Consumer information:

• Is shared solely to facilitate contact
• Must be used only for responding to the specific Request
• May not be sold, shared, retained indefinitely, or used for unrelated marketing

You agree to protect Consumer information in accordance with applicable privacy laws.

8.2 Platform Data

All Platform data, pricing structures, and operational details are confidential.

9. Platform Use and Restrictions

You agree not to:

• Attempt to bypass request limits or pricing structures
• Scrape, copy, or reverse engineer Platform systems
• Interfere with Platform operations
• Solicit Consumers outside the scope of the Request

Violations may result in immediate termination.

10. Suspension and Termination

CremateConnect may suspend or terminate Provider access:

• For violations of these Terms
• For expired or invalid licenses
• For harmful consumer behavior
• At our discretion to protect Platform integrity

Outstanding balances remain payable upon termination.

11. Intellectual Property

All Platform content, branding, and systems are owned by or licensed to CremateConnect.

You may not:

• Use CremateConnect branding without permission
• Represent yourself as an agent or partner of CremateConnect

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

We disclaim all warranties, including:

• Lead quality
• Consumer responsiveness
• Platform availability

13. Limitation of Liability

To the maximum extent permitted by law:

• CremateConnect is not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees paid by you to CremateConnect in the preceding 12 months

14. Indemnification

You agree to indemnify and hold harmless CremateConnect from any claims arising from:

• Your services
• Your communications with Consumers
• Your violation of law or these Terms

15. Changes to These Terms

We may update these Provider Terms from time to time.

Continued use of the Platform constitutes acceptance of any updates.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
